What to Do If the CCF Refused to Delete Your Red Notice
A refusal by the Commission is not necessarily the end. Where new facts have emerged since the decision — a discontinuance, an acquittal, a change in the requesting country, newly obtained judicial material — an application for revision can be made. It is not an appeal on the same material, and it will not succeed as one.
What counts as a new fact
- Discontinuance
- The proceedings in the requesting state have been dropped since the decision.
- Acquittal
- A court has determined the matter in your favour.
- New judicial material
- Documents that were not before the Commission and that change the picture.
- Changed conditions
- A material change in the situation relied on when the request was refused.
How it differs from the first application
The first application argues that the data breaches the rules on the material as it stands. Revision argues that the material has changed. Repeating the original argument more forcefully is the most common reason a revision fails. What is a request for revision?

Can a red notice be reissued after deletion?
The requesting country can submit a new request. Whether it is accepted depends on the same rules, and the earlier decision is part of the context.
Will removing a red notice remove the national warrant?
No. The warrant in the requesting country is a separate matter, unaffected by the deletion of international data.
