Removing an INTERPOL Diffusion

What we do

We act to have a diffusion deleted from INTERPOL’s files. The route is the same as for a red notice — a request to the Commission for the Control of INTERPOL’s Files — but the starting position is worse in one respect: a diffusion is not published anywhere, so until an access request comes back there is nothing to read and nothing to argue against.

A diffusion is circulated by the requesting country directly to other member countries, with lighter prior review than a notice receives. It can seek the same thing, including provisional arrest pending extradition. What a diffusion is and how it differs from a notice is set out separately.

Why people only find out late

No publication
A diffusion appears in no public extract. Checking a public list tells you nothing about one.
Direct circulation
It travels country to country through the Organization’s channels, not as a decision of the Organization.
Lighter prior review
Which is the source of most criticism of the instrument.
Same effect sought
Up to and including provisional arrest.
Same reviewability
The data is held in the Organization’s files and is subject to the same rules.

In practice the first sign is a border stop, a visa refusal or a bank letter. The only route that establishes anything is a request for access to your own data — how to check whether you are listed.

How common diffusions are

They are not a marginal instrument. Of the 1,157 admissible access and deletion requests in 2024 where the applicant was in fact subject to data, 29 per cent (335) concerned diffusions, against 59 per cent (687) concerning notices and 12 per cent (135) other categories of data. Close to one file in three before the Commission is a diffusion.

What instructing us involves

  1. Free first assessment

What happened, which country the case comes from, and whether there is a ground we could evidence. If there is not, we say so and stop.

  2. Access request

The filed step that establishes whether a diffusion exists and what it records. Nothing can be drafted honestly before it returns.

  3. Application for deletion

On the grounds the record supports — data quality, purpose, or the political character of the request.

  4. Where arrest is live

We instruct counsel admitted in the country holding you; detention is decided under that country’s law, separately from the diffusion.

The grounds themselves do not differ from those argued against a notice — grounds for deleting a red notice, and how we run a removal application.

A diffusion is invisible until you ask

There is no public list to check. The first step is a request for access to your own data, and it costs nothing to discuss.

Frequently asked

Can an INTERPOL diffusion be removed?

Yes. Data circulated by diffusion is held in the Organization’s files and is subject to the same rules on accuracy, purpose and political neutrality as a notice.

How do I find out whether a diffusion names me?

Through a request for access to your own data. Diffusions are published nowhere, so no public check will show one.

Is a diffusion less serious than a red notice?

Not in its effect. It can seek provisional arrest in the same way. It receives lighter prior review, which is a criticism of the instrument rather than a comfort to the person named.

Does removing a diffusion stop the case at home?

No. Deletion binds the Organization, not the requesting country’s own proceedings.

Can a diffusion be reissued after deletion?

A country can submit new data. What it cannot do is re-circulate data the Commission has found non-compliant on the same basis.
